Most Ridiculous Celebrity Lawsuit of the Week: Sofia Vergara Sued by Frozen Embryos

Michelle McCarthy /   January 2, 2017 /   Featured, Featured Lawyer, Lawyer /   Leave a Comment

Every kid fights with his or her parents. But this saga takes that rite of passage to a whole new (icky) level. Modern Family star Sofia Vergara is being sued by her frozen embryos. But wait, it gets worse. They’ve been named “Emma” and “Isabella.”

Backstory: Before she married Joe Manganiello in 2015, Sofia was engaged to Nick Loeb. Unfortunately, Sofia and Nick parted ways AFTER taking steps that may haunt her for days to come. Back in 2013, the pair attempted to have a baby via surrogate, but the procedure was a no-go. Perhaps from the stress of it all, the relationship ended and they were left with two frozen female embyros. That’s when the true War of the Roses kicked off.

Sofia and Nick signed papers clearly laying out what should be done if the embryos were not used: If one of them died, they would be destroyed. And the embryos would only be implanted if both of them agreed to it. It seems as though Nick doesn’t hold legal documents in high regard because he has been fighting for the rights to “Emma” and “Isabella” in what is escalating into an extremely dirty and sad affair.

Nick claims the embryos are alive and he is willing to release Sofia from all parental responsibility. He also says the exes never stipulated what should happen to the embryos if the couple broke up. Sofia would rather stick to their original agreement and thinks bringing kids into the world whose parents can’t stand each other is a bad idea.

So now Nick has filed yet another lawsuit, this time in the conservative state of Louisiana where he has set up a trust for “Emma” and “Isabella.” According to Page Six, the lawsuit states that “Emma and Isabella, by not being born, have been deprived of an inheritance from a trust that has been created for them…[and] asks that the frozen embryos be given to Loeb so that they can live and receive the trust set up for them, which would fund, among other things, their healthcare and education.”

The only tiny glimmer of hope we can squeeze out of this nightmare scenario is this: The next time you think you hold the crown on worst breakup ever, keep poor Sofia in mind.
